Tax-Deductible Giving

I donate to a charity — can I deduct my gift from taxes? Yes, you can, as long as your donation is made to an ANBI (Public Benefit Organization). Cash donations are not deductible.

Tax law defines when donations to charities are tax-deductible, and this falls under income tax rules. For companies that pay corporate tax, different regulations apply. A key requirement for tax deductibility is that the receiving organization is recognized as an ANBI.

ANBI organizations do not pay tax on the donations they receive, which means they can use 100% of the funds for their mission. If a donation is linked to a direct benefit or return service, the organization may be required to pay gift tax.

Tax Deduction: Regular Donations

The tax authorities distinguish between regular (one-off) donations and periodic donations.

A regular donation is an occasional gift that is not fixed in a formal agreement. These donations can be tax-deductible under certain conditions.

There is a threshold: the total amount of donations must exceed 1% of your “aggregate income,” with a minimum of €60. Aggregate income includes income from boxes 1, 2, and 3, excluding personal deductions. Anything above this threshold can be deducted.

There is also a maximum: total deductible donations cannot exceed 10% of your aggregate income.

Tax Deduction: Periodic Donations

Periodic donations are 100% tax-deductible for income tax purposes, with no threshold. However, there is a maximum limit of €250,000 per household per year.

To qualify as a periodic donation, the following conditions must be met:

  • The donation is made to an ANBI or qualifying association

  • The donation is recorded in a formal agreement (either via a notary or directly with the ANBI)

  • No direct compensation or benefit is received in return (receiving newsletters or updates is allowed)
